Outcome – Planning Permit WH/2016/622 was issued on 26 June 2017 by the City of Whitehorse subject to conditions including the removal of the fourth floor (containing six two-bedroom apartments and one three bedroom apartment)
and a corresponding reduction of seven car parking spaces and one bicycle space.
Terrain then applied to VCAT to contest this condition.
On 30 November 2017, VCAT directed Council to issue a modified planning permit which deleted the condition requiring the deletion of the fourth floor and associated car and bicycle parking.
