Rethinking Family Separation: Property Solutions That Put Children First

I recently had the pleasure of speaking with Deborah Wilson, Partner and Accredited Family Law Specialist at Resolve Conflict Family Lawyers, about something close to many of us—how separation affects families, especially children.

Too often, the standard response in family breakups is to sell the home and split the proceeds. But what if there were smarter, more compassionate alternatives?

We explored three innovative property strategies that aim to reduce disruption for children while helping both parents move forward:

  1. Granny Flat / Studio – Build a small second dwelling in the backyard, supporting co-parenting or generating rental income.
  2. Subdivision with New Rear Dwelling – Create two titled homes on the one property, giving both parents a fresh start without uprooting the kids.
  3. Subdivide and Sell Rear Land – Free up equity by selling part of the land, maintaining stability in the family home.

Each solution depends on land size, planning rules, and family dynamics—but when feasible, they can make a real difference.

These ideas put children’s routines and wellbeing at the centre. They also show how collaboration between legal and property professionals can unlock real-world solutions.

What are your thoughts? Have you seen or experienced family-focused property solutions like these?
